Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Missouri Trappers Association (“MTA,” “we,” “us,” or “our”) website (www.missouritrappers.com) and any related pages, memberships, events, donations, education programs, and online services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility & Account Responsibilities

  • Eligibility: You must be at least 18 years old (or the age of majority in your jurisdiction) to use most Services without supervision. Minors may participate in youth programs with verifiable parental/guardian consent and supervision as required.
  • Accurate Information: You agree to provide accurate, current, and complete information when creating accounts, registering for events, or purchasing memberships.
  • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Compliance: You agree to comply with all applicable laws and regulations, including those of the Missouri Department of Conservation (MDC).

2. Community Standards & Code of Conduct

MTA is a family-friendly, educational community. When engaging online or at MTA events, you agree to:

  • Demonstrate respect for others, including volunteers, staff, instructors, vendors, and attendees.
  • Follow event rules, safety instructions, and all applicable laws and regulations.
  • Avoid harassment, discrimination, threats, or disruptive behavior.
  • Use ethical and humane practices when demonstrating or discussing trapping techniques.
  • Respect property rights and obtain permissions where required.

We may remove content, suspend accounts, or ask individuals to leave events for violations of this Code.

3. Memberships, Donations, Event Registration & Transactions

  • Payments: Payments are processed by third-party providers such as [payment processor]. We do not store full card numbers. By submitting a payment, you authorize charges for the indicated amount.
  • Renewals: If you enable auto-renewal, you authorize recurring charges until canceled. You can cancel auto-renewal before the next billing date.
  • Refunds: Unless otherwise stated on a specific event or product page, all sales are final. If MTA cancels an event, we will provide a refund or credit per the event policy.
  • Donations: Donations may be tax-deductible to the extent permitted by law; consult your tax advisor. MTA will issue receipts for qualifying donations.
  • Merchandise: Any shipping, returns, or exchanges will follow the posted store policy at the time of purchase.

4. User Content & License Grants

“User Content” means text, photos, videos, feedback, or other materials you submit or post via the Services.

  • Your Responsibility: You represent that you own or have the necessary rights to your User Content and that it does not infringe or violate any rights or laws.
  • License to MTA: You grant MTA a nonexclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify (for formatting or accessibility), and promote your User Content in connection with the Services and MTA’s mission, with proper credit where feasible.
  • Feedback: If you provide suggestions or feedback, you grant MTA a perpetual, irrevocable, worldwide, royalty-free right to use them without obligation.

5. Intellectual Property

The Services and all content provided by MTA (including text, graphics, logos, photographs, videos, and educational materials) are protected by intellectual property laws. Except as expressly permitted, you may not copy, distribute, or create derivative works without prior written permission from MTA.

6. Prohibited Activities

  • Violating laws or MDC regulations.
  • Posting unlawful, harassing, defamatory, obscene, or misleading content.
  • Infringing intellectual property or privacy rights of others.
  • Attempting to gain unauthorized access to our systems or user accounts.
  • Introducing viruses, malware, or harmful code.
  • Scraping or harvesting data without our written consent.
  • Impersonating any person or misrepresenting your affiliation.

7. Outdoor Activities, Assumption of Risk & Safety

Trapping, field demonstrations, and outdoor education involve inherent risks, including but not limited to weather, terrain, wildlife encounters, tools, and transportation.

  • Assumption of Risk: By registering for or participating in MTA activities, you acknowledge these risks and agree to participate voluntarily.
  • Safety: You agree to follow all safety instructions and use appropriate gear. MTA may remove participants who disregard safety guidance.
  • Health & Ability: You are responsible for determining your fitness to participate and for disclosing any conditions that may require accommodations.
  • Insurance: You are responsible for your own medical, health, and property insurance.

8. Photo, Video & Media

We may capture photos or videos at events for educational and promotional purposes. By attending, you consent to the use of your likeness, voice, and participation, without compensation, in MTA materials, unless you notify us in writing at or before the event and we are able to reasonably accommodate your request.

9. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information.

10. Third-Party Services & Links

The Services may include links to third-party websites or integrations (e.g., payment processors, email platforms, social media). MTA is not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk and subject to their terms and policies.

11. Disclaimers

  • No Professional Advice: Content is for educational purposes only and is not legal, medical, veterinary, or professional advice. Consult qualified professionals for specific guidance.
  • As-Is Basis: The Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Availability: We do not guarantee continuous, error-free, or secure access to the Services.

12. Limitation of Liability

To the fullest extent permitted by law, MTA and its officers, directors, volunteers, members, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any conduct or content of any third party; or (c) unauthorized access, use, or alteration of your transmissions or content. In no event shall MTA’s aggregate liability exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid to MTA in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless MTA and its officers, directors, volunteers, members, agents, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.

14. Copyright Complaints (DMCA)

If you believe content on the Services infringes your copyright, please send a written notice to our designated agent with the following: (a) your contact information; (b) identification of the copyrighted work; (c) identification of the infringing material and its location; (d) a statement that you have a good-faith belief that use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and you are the copyright owner or authorized to act; and (f) your physical or electronic signature.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Except as provided in Dispute Resolution, the exclusive venue for any disputes arising out of or relating to these Terms or the Services shall be the state and federal courts located in Missouri, and you consent to the jurisdiction of such courts.

16. Dispute Resolution

  • Good-Faith Negotiation: Before filing a claim, the parties will attempt to resolve the dispute informally for at least 30 days after written notice of the dispute.
  • Arbitration (Optional Clause): Except for small-claims matters or claims seeking injunctive relief, disputes may be resolved by binding arbitration conducted in Missouri by a recognized arbitration provider and under its rules. If you prefer not to include arbitration, remove this paragraph before publishing.
  • Injunctive Relief: Either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of rights.
  • Class Action Waiver: To the extent permitted by law, disputes will be resolved only on an individual basis and not as a class, consolidated, or representative action.

17. Changes to the Services or Terms

We may modify the Services and these Terms from time to time. Changes are effective when posted, as indicated by the “Last Updated” date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

18. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to MTA, our community, or the public. Upon termination, sections that by their nature should survive (including ownership, disclaimers, limitations of liability, indemnification, and governing law) will survive.

19. Miscellaneous

  • Entire Agreement: These Terms, together with any policies referenced herein (including the Privacy Policy), constitute the entire agreement between you and MTA regarding the Services.
  • Severability: If any provision is found unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms in connection with organizational changes consistent with nonprofit law.
  • Headings: Headings are for convenience only and do not affect interpretation.
